HPD Police Records Requests

Effective January 1st, 2018:  All public records requests must be submitted in writing using the Hermiston Police Department request form or submitting an online request via our Police Records Request Center.

 

Requesters that do not wish to submit via our online request center may submit a written request on our department form in person, via email, fax, or by mail to:

Procedure for Public Records Requests - What to Expect

  1. Complete the online request and/or return the Records Request form.
  2. The Hermiston Police Department shall acknowledge the submission of the public record request within five (5) working days of receipt.
  3. The Hermiston Police Department, after acknowledgment, shall respond to your record request within ten (10) working days with the estimated fees incurred to fulfill the request.
    1. Oregon law allows City's to recoup costs, from requesters, to fulfill records requests.
    2. Fees must be paid prior to the request being processed.  The timeframe to complete the request is paused until payment is received.
  4. Once the fees have been paid, the Hermiston Police Department shall fulfill the public records request within ten (10) working days or notify you that more time is needed to fulfill the request and provide you with an estimated date of completion.
    • Please note:  All timeframes mentioned are excluding staff absences.
  5. Once the record request has been completed, they will be furnished to the requester in the manner they have indicated on the form.

 

Associated Fees

Requesters must pre-pay the estimated cost of the request.  The majority of fees are non-refundable but if the actual charges are less than the pre-payment, then the over-payment shall be refunded.  The fees listed below are the most commonly assessed to records requests.  Please contact our office for an estimate of fees associated with your request before payment.  Our office accepts payments via credit/debit card, check or money order, and exact cash when paying in person.  Do not mail cash payments.

  • $0.25 per page -  Printed full-page black & white photo(s)
  • $1.00 per page -  Printed full-page color photo(s)
  • $5.00 -  Citation copy
  • $5.00 -  Mugshot copy
  • $20.00 -  Address/Name Record Check
  • $20.00 -  Police CAD Incident Report
  • $20.00 -  Police Investigation Report (Digital or Printed)
    • Digital Copy Includes:  The initial report and supplemental reports completed at the time of the request, along with color full-page photographs.
    • Printed Copy Includes:  The initial report, supplemental reports completed at the time of the request, along with color photographs in gallery/thumbnail view.  Full-page color photos would cost $1.00 per page.
  • $35.00 -  Minimum charge for a copy of audio and video recordings, in addition to other fees.  
  • $35.00 -  "Lengthy requests" means requests over 15 minutes to complete, in addition to other fees.  Fees are charged at 15-minute increments. 

 

Public Disclosure of Reports

Every effort will be made to disclose as much information as possible while complying with the Oregon Public Records Laws Oregon Revised Statutes 192.311 to 192.478 including but not limited to: 

  • The time, date, location, nature, and description of a reported crime, accident, or incident.
  • The name, sex, age, and address of a person arrested except as otherwise provided by law.
  • The date, time, and location of the incident and the arrest, and the crime charged.

 

Exemptions from Public Disclosure

Oregon Revised Statutes 192.311 to 192.478 provides that notwithstanding any statute or rule of the court to the contrary, a law enforcement agency’s investigatory records compiled for law enforcement purposes are exempt from disclosure to the extent their purpose would:

  • Interfere with enforcement proceedings.
  • Deprive a person of a right to a fair trial or an impartial adjudication.
  • Constitute an unwarranted invasion of personal privacy.
  • Disclose the identity of a confidential source.
  • Disclose investigative techniques and procedures.
  • Endanger the life or safety of parties involved in an investigation.
  • Endanger the life or safety of law enforcement personnel.
